So, if anything is in these Terms and Conditions, including liability exclusions, that you disagree with, are not willing to be bound by, or if something is missing from these Terms and co0ndtions, no alterations to these terms and conditions may be made unless in writing by an authorized officer of NES. These terms and conditions apply to all travelers for any Journey taken by members and their guests. These conditions are non-negotiable and should be read by each traveler before each Journey.

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with NES by any means, including our Website in accordance with all TOC herein. You agree to be financially responsible for all of your travel bookings.
Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services. 2b. Limitations of Responsibility and Disclosure
NES acts solely as a private travel society and uses disclosed principal supplier hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”), and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not subject to the control of NES. Customer is advised that the suppliers whose names appear in travel documentation held by the Host, are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and are set forth on their respective Web sites, which govern the transactions, and can be accessed at the request of the Traveler. All bookings are accepted by NES as private society for the travel suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective Web sites. Because NES acts as private society for disclosed principal suppliers, and does not have the right to control the operations of such independent operators and suppliers, you agree NES is not liable for any personal injury or property damage, which may arise out of these services. NES hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special consequential, incidental or indirect damages, in connection with the goods or services provided by any principal supplier booking through NES or through this web site, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, wilful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, prices increases, and other matters outside of NES control, and you hereby exonerate NES from any liability with respect to the same.
2c. Weather Conditions and Liability
Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of NES control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of NES. NES reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. NES shall not assume any responsibility for any air and/or ground schedule changes. NES has solely received commission and fees for travel transactions and Customer agrees and understands that any recovery from NES will be limited to the commission and fees paid by Customer actually received by NES if applicable.

NES shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. If NES, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by NES to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although NES shall use its reasonable efforts to reimburse you where possible. However, NES shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to NES of the Force Majeure and applicable cancellation fees. Regarding civil unrest, once NES has investigated the prevailing situation, as it deems fit, it shall remain in NES sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to NES and each supplier’s terms and conditions.
3. NES Non-Member Guests
Non-member Guests for NES members is a privilege and a responsibility of the member who invites them. the non-member guest must abide by all NES Standards and these TOC, before being allowed on any Journey. If any action that is not in accordance with NES Standards or this TOC is performed by the guest, the member who brought the guest may be liable for those actions as well, and if the offense is objectionable enough, an immediate termination may occur for the member, which would terminate any of the agreement of that Journey. Any refunds for the rest of the Journey may be subject to the approval of the Host(s) at the the time. If the offense is taken by the guest of the member, and no responsibility is found of the member, determined by the Host(s) then the Host(s) may choose to only terminate the Journey of the guest with no liability to the member. Minor offenses be considered a pass for the rest of the Journey, but still may reflect negatively upon the membership and invitation to for any future Journeys both for the guest and the Member.
4a. Travel Documents, Including TSA and Acceptable Identification Requirements
It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. For residents of other Countries, check with your appropriate Countries governmental departments.
4b. Health Matters & Travel Health Documentation
Each Member and their guests are responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. NES shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Customer’s health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner before booking. 4c. Covid-19 (Amendment January, 26th 2021)
In the wake of the Sars-CoV-2 (Covid-19) pandemic many countries are now requiring vaccination proof to enter the country, and members and their guest are required to bring such documents with them. Furthermore a NES requirement, even if the destination does not require vaccination proof, all members and their guest must be fully vaccinated and must have their vaccine cards with them. The U.S. government also requires proof of non-infection from the virus , in the form of a PCR test or an antigen test within 24 hours of departure. While your Host may help you though this process, the cost and burden is ultimately your or your guests responsibility. If any case of infection occurs and you are unable to make your flight the costs and responsibility to get back to your home country falls on you and your guests. NES highly encourages Traveler insurance with Covid-19 coverage. For residents of other Countries, check with your appropriate Countries department.
5a. Individual Entry and Exit requirements for Past Criminal Offenses

(Details can be found at http://travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html. or your countries governmental sites, for non U.S. residents. We feel it is an invasion of privacy for any member of our leadership to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers.
5b. Criminal Offenses While Abroad
NES does not hold any responsibility for any illegal actions that you or your guests may preform. Any jail of prison time as well as any monetary fees like a ticket or bail, is purely up to you, and while a Host may try to help you in a situation, that is purely up to them. In any case this may result in the immediate termination of your membership. This also applies to member guests if they perform any action that reflects negatively upon NES, and you may be terminated if you were aware of the action, as stated earlier.
6. Traveler Payments and Cancelations

Transportation that required a Host as a driver, may still be done at the discretion of the members with a volunteer of the group to drive in some cases, otherwise NES and your Host(s) will try to rearrange any itinerary to fit into the budget and schedule. If a payment is late you may incur a late payment fee of at least $50 per person, this applies to members and their guests equally. Single Supplement fees vary depending on the Journey and go towards hotel rooms, transportation costs, activities, etc..., the Host will try and reduce these costs based upon availability. If a member finds a guest to join them later, many of these costs are refundable given that the costs were not' already locked in.
11. Currency Fluctuations

A brief period will be allotted for the members to decide if they can partake alone or with one guest, before additional guests are invited.
10. Payments, Late Bookings and Single Supplement Fees
There is generally a set date for payments for the Journeys, these may involve one or more payments and due dates. If you choose to join a Journey at the last moment past the initial payment date, a late fee may occur, to accommodate higher prices or changes to the groups itinerary based on rearrangement of the itinerary, transportation cost, or activities, etc....
As currency exchange rates fluctuate, prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred. Therefore, the Journey cost may be slightly higher than the actual cost to account for any exchange rate inflation at the actual time of the Journey, and may be refunded to the members and their guests if the costs remain stable.
